Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and AETC LLC ("Company", "we", "us", or "our"), governing your access to and use of Trend My Song ("TMS", "Platform", or "Service").
By accessing, registering for, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Service.
1.1 Eligibility Requirements
You may only use the Service if you meet the following conditions:
- You are at least 18 years of age, or you meet the legal age of majority in your jurisdiction
- You have full legal capacity to enter into binding agreements
- You are not restricted from using such services under any applicable laws
1.2 Representations and Warranties
By using the Service, you represent and warrant that all of the eligibility conditions above are satisfied. We reserve the right to request verification of eligibility at any time.
1.3 Additional Agreements
Your use of certain features of the Service may be subject to additional terms and policies, including but not limited to:
Governs the use of music distribution services.
Governs the use of marketing and promotion campaign services through the Trend Network.
Governs the collection, use, and protection of your personal information.
These additional agreements are incorporated into these Terms by reference. By using the applicable services, you agree to be bound by the relevant agreements.
02Use of the Platform
2.1 Nature of the Service
Trend My Song is an all-in-one cloud-based platform designed to provide music professionals and artists with the following capabilities:
Automated video editing tools that synchronize visuals with audio to create short-form and long-form promotional content, including lyric-synced videos and captions.
Distribution of music to digital streaming platforms including Spotify, Apple Music, and other DSPs, governed by the Distribution Agreement.
Playlist pitching, social media promotion, and advertising campaigns through the Trend Network, governed by the Marketing Agreement.
Ability to process multiple files and projects simultaneously.
Access to generated content for download within applicable retention windows.
2.2 Studio Functionality
The Studio is an automated editing and processing tool. It does not create original music or audio content. Users must provide their own songs, audio files, images, and other input materials.
The Studio processes user-provided content to generate promotional videos and visual content. As part of the Studio workflow, users may choose to use integrated AI-powered services, such as lyric detection tools, to assist with content creation. Use of these integrations is entirely at the user's discretion and subject to the terms of the respective third-party service providers.
2.3 Scope Limitations
The Service functions strictly as a technical processing and distribution platform. It does not perform any of the following:
- Create original music, songs, or audio compositions
- Modify user intent or creative direction
- Validate the legality, ownership, or licensing status of content provided by users
- Guarantee specific outcomes, results, or performance metrics
All outputs and results are a direct consequence of user-provided inputs, user choices, and system automation.
2.4 User Responsibilities
You agree and warrant that the following conditions are met at all times while using the Service:
- You own or have obtained full legal rights, licenses, and permissions for all content you upload, including but not limited to songs, audio recordings, images, videos, and any other materials
- Your use of the Service complies with all applicable local, national, and international laws, including copyright, trademark, and intellectual property laws
- You are solely responsible for all content you upload and all outputs generated through your account
- You are solely responsible for the downstream use, distribution, and commercialization of any content created or distributed through the Platform
- You acknowledge that Trend My Song has no control over user intent, the nature of uploaded content, or how outputs are used after generation
03Accounts & Registration
3.1 Account Creation
To access the Service, you must complete the following:
- Register an account using a valid email address
- Complete any verification steps required at the time of registration
- Provide accurate and up-to-date information during registration
As part of account management, you may receive system communications from support@trendmysong.com — platform notifications, support communications, and account-related emails.
3.2 Account Responsibility
You are solely responsible for the following:
- Maintaining the confidentiality of your account credentials
- All activities conducted under your account, whether authorized by you or not
- Ensuring that your account information remains accurate and current
We are not liable for any unauthorized access, loss, or damages resulting from your failure to secure your account credentials.
3.3 Account Suspension and Termination
We reserve the right to suspend, restrict, or permanently terminate any account without prior notice for violations of these Terms, fraud or misuse, chargeback initiation, infringing content uploads, or any activity presenting legal, operational, or reputational risk to the Company.
04Credits & Payments
4.1 Payment Structure
Trend My Song operates on a prepaid credits system. Credits are required to access and use the following services:
- Studio and content creation features
- Music distribution services
- Marketing and promotional campaigns through the Trend Network
All services on the Platform are credit-based and priced according to the current rates displayed in your account dashboard.
4.2 Pricing Adjustments
We reserve the right to make any of the following changes at any time and without prior notice:
- Modify pricing for any service or credit package
- Change the credit cost of any feature, generation, or campaign
- Introduce, modify, or remove pricing tiers or packages
4.3 Credits Usage
The following rules govern how credits are consumed:
- Credits are consumed upon the initiation of a service request, generation, or campaign
- Credit usage is considered final once processing begins or a service is activated
- Credits have no cash value, are non-transferable, and cannot be exchanged, redeemed, or refunded outside the Platform
4.4 Refund Policy
All payments are final and non-refundable. If any portion of purchased credits has been used, including minimal usage, the entire purchase becomes strictly non-refundable. Refunds may only be considered when credits have never been used and the request is made within 24 hours of purchase. Approval is at the sole discretion of the Company.
4.5 Abuse of Refund Policy
We reserve the right to deny any refund request under the following circumstances:
- Abuse patterns are detected across one or more accounts
- Multiple refund attempts are made by the same user or associated accounts
- Fraudulent activity is suspected in connection with the request
4.6 Chargebacks and Payment Disputes
If you initiate a chargeback or formal dispute with your payment provider, we may immediately terminate your account, revoke access to all Services, block future usage and registration, and pursue legal remedies for damages incurred.
05Content & Intellectual Property
5.1 User Ownership
Users retain full ownership of all input content uploaded to the Platform and all generated outputs produced from those inputs through the Studio. Ownership of outputs belongs to the user, or to the rightful owner of the input material where applicable.
5.2 Platform Rights
All rights to the Platform, including but not limited to its technology, software, user interface, design, infrastructure, and proprietary tools, remain exclusively owned by AETC LLC. No use of the Service grants you any ownership, license, or rights over Platform technology or intellectual property.
5.3 Processing License
By uploading content to the Platform, you grant AETC LLC a limited, non-exclusive, royalty-free, worldwide license to process, store, and transmit your uploaded files solely for the purpose of fulfilling your service requests, including but not limited to:
- Generating video content in the Studio
- Distributing music to digital streaming platforms
- Executing marketing and promotional campaigns
This license does not extend to any other use, including but not limited to distribution, public display, model training, or commercial exploitation beyond what is necessary to provide the requested services.
5.4 Distribution and Marketing Rights
Additional rights and licenses required for distribution and marketing services are governed by the Distribution Agreement and Marketing Agreement, respectively. By using those services, you grant the necessary rights as outlined in the applicable agreements.
5.5 Commercial Use
Users may use generated outputs for commercial purposes at their own risk and responsibility. You are solely responsible for ensuring that your inputs, outputs, and any downstream use comply with all applicable intellectual property laws, licensing agreements, and third-party rights.
5.6 User Warranties Regarding Content
You represent and warrant that:
- You own or have obtained all necessary rights, licenses, and permissions for all songs, audio recordings, images, videos, and other content you upload to the Platform
- Your content does not infringe upon any copyright, trademark, patent, trade secret, or other intellectual property or proprietary rights of any third party
- Your content does not violate any applicable laws or regulations
- You have the authority to grant the licenses described in these Terms
06Data & Privacy
Certain files and outputs are subject to automatic deletion. The default retention period is 24 hours after processing is complete. Files subject to auto-deletion will show a countdown timer in the "All Creations" section of your dashboard. If no countdown is shown, the content is not subject to auto-deletion.
Content exempt from auto-deletion includes content related to distribution services, marketing campaigns and services, account data, and user information.
6.1 Temporary Storage
Files uploaded to the Platform are subject to the following storage rules:
- Files are stored temporarily for processing purposes only
- Files subject to auto-deletion are automatically and permanently deleted according to the applicable retention window
- The deletion timer begins only after processing is completed and the output becomes available for download
6.2 No Permanent Storage Guarantee
We do not provide any of the following:
- Archiving of user files beyond the applicable retention window
- Long-term or permanent storage guarantees for content subject to auto-deletion
- Guaranteed availability of files after the retention window has elapsed
Users are responsible for downloading and backing up their content within the applicable retention window.
6.3 Access to Content
User content is processed automatically by the Platform's systems. Our team does not manually access, view, or review user content under normal circumstances. Access is limited strictly to the operational processing needs required to fulfill your requests.
6.4 AI Training
We do not use user data, uploaded content, or generated outputs for AI model training. We do not analyze user content beyond what is strictly required for processing and service delivery.
6.5 Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it at /policies/privacy to understand how we collect, use, and protect your personal information.
6.6 Policy Changes
Storage duration, retention windows, and related data policies may be modified at any time. Users will be notified of any material changes in advance where reasonably practicable.
07Prohibited Conduct
You agree not to use the Service for any of the following purposes:
- Infringing upon any intellectual property rights, including copyrights, trademarks, patents, or trade secrets
- Uploading or distributing content that is illegal under any applicable law or jurisdiction
- Producing or distributing harmful, hateful, violent, defamatory, or abusive material
- Engaging in fraud, abuse, exploitation, harassment, or deceptive practices of any kind
- Circumventing, disabling, or otherwise interfering with system limitations, access controls, security measures, or Platform protections
- Using the Service to distribute spam, malware, or other malicious content
- Impersonating any person or entity, or falsely representing your affiliation with any person or entity
- Attempting to gain unauthorized access to any part of the Service, other user accounts, or related systems
7.1 Enforcement
In response to any violation, we reserve the right to remove associated content, restrict or revoke access to all or part of the Service, suspend or terminate the offending account immediately and without prior notice, report violations to relevant authorities, and pursue legal remedies for damages incurred.
08Disclaimers & Limitation of Liability
8.1 Service Availability
We make no guarantees regarding the availability or continuity of the Service. We do not guarantee uninterrupted uptime, continuity of any specific feature or functionality, or the absence of bugs, errors, or technical issues. We reserve the right to modify features, suspend services, perform maintenance, or discontinue any part of the Platform at any time and without prior notice.
8.2 Warranty Disclaimer
We expressly disclaim all warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement; accuracy, reliability, or quality of outputs produced by the Platform; and performance, uptime, or availability guarantees of any kind.
8.3 No Performance Guarantees
We do not guarantee any of the following outcomes from use of the Service:
- Processing speed, turnaround time, or delivery timelines
- Consistency of output quality across generations or projects
- Success of distribution efforts, including playlist placements, streaming numbers, or chart performance
- Success of marketing campaigns, including reach, engagement, conversions, or audience growth
- Business results of any kind, including revenue, views, followers, or commercial success
Marketing and promotional services are provided on a best-effort basis and are heavily dependent on third-party algorithms, platform policies, and market conditions beyond our control.
8.4 Third-Party Integrations
The Platform may integrate with third-party services, including but not limited to AI-powered tools, digital streaming platforms, and advertising networks. We are not responsible for the availability, performance, or reliability of third-party services; the accuracy of outputs generated by third-party AI tools; changes to third-party terms, policies, or functionality; or actions taken by third-party platforms regarding your content.
8.5 Limitation of Liability
To the maximum extent permitted by applicable law, our total liability to you for all claims arising out of or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim. Your use of the Service is entirely at your sole risk.
We shall not be liable for indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, data, business opportunities, or goodwill; damages from unauthorized account use; failure to achieve desired results from distribution or marketing services; loss or deletion of content due to retention window expiry; or technical failures, errors, or interruptions in service.
8.6 Indemnification
You agree to indemnify, defend, and hold harmless AETC LLC and its officers, directors, employees, contractors, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Any content you upload, generate, or distribute through the Platform
- Your violation of these Terms or any applicable law or regulation
- Your infringement of any third-party rights, including intellectual property rights
- Any disputes arising from your distribution or marketing activities
09Termination
9.1 Termination by the Company
We reserve the right to suspend, restrict, or permanently terminate your account at our sole discretion and without prior notice under any of the following circumstances:
- Violation of any provision of these Terms or any additional agreements
- Engagement in abuse, fraud, misuse, or prohibited conduct
- Initiation of a chargeback or payment dispute
- Uploading content that infringes on third-party rights or violates applicable laws
- Activity that presents legal, operational, reputational, or financial risk to the Company
9.2 Termination by the User
You may discontinue use of the Service and request deletion of your account at any time by contacting us at support@trendmysong.com. Account deletion requests will be processed in accordance with our Privacy Policy.
9.3 Effect of Termination
Upon termination of your account, the following will apply:
- Your access to the Service will be immediately revoked
- Any unused credits remaining in your account will be forfeited and are non-refundable
- All uploaded and generated files subject to auto-deletion will be deleted in accordance with the retention policy described in Section 6
- Content related to active distribution or marketing services may be retained as necessary to fulfill contractual obligations with third parties
- Provisions of these Terms that by their nature should survive termination will remain in effect, including but not limited to liability limitations, indemnification, intellectual property rights, and dispute resolution provisions
10Changes to These Terms
We may update these Terms at any time. Registered users will be notified by email or via an in-platform notice. The updated version will be posted on the Platform with a new effective date. Continued use of the Service following notification of any changes constitutes your acceptance of the updated Terms.
We encourage you to review this page periodically to stay informed of your rights and obligations.
11General Provisions
11.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
11.2 Dispute Resolution
Before initiating any formal legal action, you agree to the following process:
- Contact us via email at support@trendmysong.com to notify us of the dispute
- Engage in good faith efforts to resolve the matter informally within a reasonable timeframe
- If the dispute cannot be resolved informally, both parties agree to submit to the exclusive jurisdiction of the courts located in the United States
11.3 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
11.4 Entire Agreement
These Terms, together with the Privacy Policy, Distribution Agreement, and Marketing Agreement, constitute the entire agreement between you and AETC LLC regarding the use of the Service and supersede all prior agreements and understandings.
11.5 No Waiver
Our failure to enforce any provision of these Terms shall not be deemed a waiver of such provision or our right to enforce it in the future.
11.6 Assignment
You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms at any time without restriction.
